Welcome to ParkLume, a mobile application provided by Parkworks Mechanical Systems (“we,”, “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of ParkLume (“App”). By downloading, installing, or using ParkLume, you agree to these Terms. If you do not agree to these Terms, please do not use the App.
1. Eligibility
To use ParkLume, you must:
- Be at least 18 years old.
- Be a resident of the Lume apartment complex in Palo Alto.
- Have an active account authorized by Parkworks Mechanical Systems.
2. Account Responsibilities
When you create an account on ParkLume:
- You must provide accurate, current, and complete information.
- You are responsible for maintaining the confidentiality of your login credentials and are fully responsible for all activities that occur under your account.
- If you suspect unauthorized access, notify us immediately at [email protected].
3. Use of the App
ParkLume is intended to help residents of the Lume apartment complex access parking and vehicle management services, including:
- Checking vehicle status in the automated parking system.
- Requesting remote vehicle retrieval, available only when the vehicle is in the garage.
- Accessing EV charging session history, for enrolled users.
You agree to use ParkLume solely for its intended purposes and in compliance with all applicable laws and regulations.
4. Acceptable Use Policy
You agree not to:
- Use ParkLume for any unlawful purpose or in any way that could damage, disable, overburden, or impair the App.
- Attempt to gain unauthorized access to any part of the App, other accounts, or networks connected to the App.
- Use any robot, spider, scraper, or other automated means to access the App for any purpose without our express written permission.
- Interfere with the proper working of ParkLume or circumvent any security measures.
5. Data Collection and Privacy
Our Privacy Policy, which explains what data we collect and how we use it, is incorporated by reference into these Terms. By using ParkLume, you agree to the collection and use of your data as described in the Privacy Policy. You can access the full Privacy Policy in the App’s settings or on our website at https://www.parkworksus.com/privacy-policy/.
6. Intellectual Property
All content, features, and functionality in ParkLume are the property of Parkworks Mechanical Systems or its licensors and are protected by copyright, trademark, and other laws. You are granted a limited, non-exclusive, non-transferable license to use ParkLume, and you may not use any content without permission.
7. Updates and Modifications
We reserve the right to update, modify, or discontinue ParkLume, temporarily or permanently, with or without notice. We are not liable if any part of the App is unavailable at any time.
8. Termination
We may terminate or suspend your access to ParkLume at our sole discretion if you breach any provision of these Terms. Upon termination, your right to use the App will immediately cease, and you must delete the App from your device.
9. Disclaimers and Limitation of Liability
ParkLume is provided “as is” without warranties of any kind, either express or implied. Parkworks Mechanical Systems does not warrant that the App will be error-free, uninterrupted, or compatible with all devices. To the fullest extent permitted by law, Parkworks Mechanical Systems will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of ParkLume, including damages for loss of data or goodwill.
10. Indemnification
You agree to indemnify, defend, and hold harmless Parkworks Mechanical Systems, its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses arising out of or related to your use of ParkLume or breach of these Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the state of California, without regard to its conflict of law principles. You agree that any disputes arising from these Terms will be resolved in the courts located in California.
12. Changes to the Terms
We may update these Terms periodically. Any changes will be posted on this page, and the “Last Updated” date will be revised accordingly. Continued use of ParkLume after changes are made constitutes acceptance of the updated Terms.
